Patents and Patentability
This session
is taught by two Florida registered patent attorneys. Through the exclusive rights granted by
patent laws for a limited period of time, a patent owner has the potential to
gain a dominant market position with regard to the scope of the invention.
Patents provide their owners control over the making, using, selling, or
importing of an invention. This module presents both the creation of patent
rights as well as the enforcement of such rights (and defenses against
infringement claims). These include
practical considerations and ethical and legal constraints that lawyers must
consider under the patent Bar rules when counseling clients on translating
research into a patented process, machine, article of manufacture, or
composition of matter without unintentionally destroying the exclusivity in the
patent or diminishing its value.
